Delivery, damage and cancellation information — in full for today's enquiry-based orders, and prepared in advance for when the online shop launches.

Draft — owner confirmation required

This page is a structured draft, not final legal text. Items marked [owner confirmation required] must be completed and the whole page reviewed (ideally with a legal adviser for German/EU/UK food retail) before the site goes live. This page is excluded from search engines until then.

Sections below written out in full are a reasoned starting position, marked (drafted default — confirm before publishing) where no business decision is on record yet. Items marked [owner confirmation required] are left open rather than guessed, because they are concrete operational facts — a carrier, a price, a transit time — not a legal position, and none exist yet. See also the Terms and conditions page, which covers contract formation, pricing/VAT/incoterms, and the consumer right of withdrawal in full.

Today (enquiry-based sales)

This website does not yet operate a live checkout. Delivery terms are agreed per order: local delivery and pickup in The Gambia for retail and wholesale; agreed Incoterms (typically FOB Banjul) for export. Exact costs, timing and responsibility for the goods in transit are confirmed in your written quote or order confirmation, as described in Section 3 of the Terms and conditions.

Shipping areas, carriers, costs and delivery times

  • Which countries we ship retail orders to, and which carrier(s) we use for Germany, the wider EU and the UK — [owner confirmation required].
  • Shipping cost table and any free-shipping threshold, per destination — [owner confirmation required].
  • Estimated delivery time per destination — [owner confirmation required].

None of the above exists yet, so none is stated here as a placeholder figure — it will be added once decided, rather than defaulted. Until then, every order's shipping terms are agreed individually (see "Today" above).

Cancellation and the right of withdrawal (consumers)

If you are a consumer, once direct online retail sales begin you will have a 14-day right of withdrawal from your order, with a model withdrawal form, exactly as set out in Section 5 of the Terms and conditions. That right does not apply once you unseal sealed cashew or peanut packaging after delivery, for hygiene reasons, under § 312g(2) no. 2 BGB and the equivalent UK Consumer Contracts Regulations 2013 exception — you can still withdraw from unopened, sealed items within the 14 days. Return shipping cost allocation is covered in the same section (drafted default — confirm before publishing).

For wholesale and export (B2B) orders, there is no statutory right of withdrawal; buyers must inspect goods on arrival and notify defects promptly, as set out in Section 4 of the Terms and conditions (§ 377 HGB inspection duty).

Damaged, missing or incorrect deliveries

If your order arrives damaged, incomplete, or different from what was confirmed, contact us at kairabaproduction@gmail.com with your order reference, a description of the problem and, where possible, photos of the goods and packaging as received. We aim to acknowledge any such report within a few working days and agree a resolution — a replacement, a partial or full refund, or another remedy — on a case-by-case basis (drafted default — a specific response-time commitment and standard remedy process should be confirmed before publishing). For wholesale and export orders, this is in addition to, not instead of, the inspection and notice obligations in Section 4 of the Terms and conditions.

This complaints process does not reduce your statutory consumer rights in cases of defective goods (see Section 7, Liability and warranty, of the Terms and conditions).
